These are the two most controversial NYPD “friendly fire” incidents:
* In August 1994, black plainclothes Transit Officer Desmond Robinson was mistaken for a criminal and shot four times in the back in an East Side subway station.
Officer Peter Del-Debbio, off duty and on his way home, shot Robinson as Robinson responded to the scene after a teenager dropped a shotgun on the platform and it went off.
Del-Debbio was convicted of second-degree assault and sentenced to time served plus five years probation. He was dismissed from the NYPD following his conviction.
Robinson retired on disability and is suing the city and Del-Debbio for $50 million. Earlier this month a judge ruled the city liable and ordered that the case go to trial.
* In November 1992, black undercover cop Darwin Pannell, was shot and seriously wounded in a dimly lit Brooklyn subway station while arresting a fare-beater.
Two uniformed officers, John Napolitano and Robert Green, shot at Pannell 21 times after mistaking him for a mugger.
The two officers were cleared of wrongdoing by a grand jury.
