A police officer opened fire at a black Mercedes-Benz owned by the rapper Capone as he attempted to flee a wild fracas at a Queens nightclub early yesterday, police said.
Lt. Alan Desmond fired two shots at the car because he thought one of the three occupants had a gun, and frightened patrons said that the trio had weapons, police said.
Marion Jefferson, 20, a buddy of the rapper, suffered a neck injury – he was either grazed in the neck by a bullet or hit by flying glass, police said.
But the three fled before being stopped by cops several blocks away.
Capone, 25, whose real name is Kiam Holley, was charged with second-degree assault in the club fight. So was Jefferson, who was treated at Elmhurst General Hospital and released.
Police recovered a .380 automatic handgun from the club, the Mercurio 2000, and cops haven’t found a gun in the car.
The incident unfolded about 3:45 a.m. during a party at the Long Island City club, near the Queensbridge housing project where Capone, half of the duo of Capone-N-Noreaga, grew up.
Two men claimed Capone and Jefferson attacked them, police said.
A gun reportedly was brandished and clubgoers rushed out. At that point, Desmond and Officer James Dee arrived.
