The husband and wife accused of having public group sex with the husband’s brother on a Long Island Rail Road train are nearing a climax in the case – a plea deal that would get them no jail time and only a violation for the wife.
Under the proposed deal, a source said, Lyle Greene and his brother Dennis would plead guilty to the public orgy and Lyle Greene’s wife, Francine, 40, a mother of two, would plead guilty to a “disorderly conduct violation.”
The two brothers would each have to plead to public lewdness, a “B” misdemeanor, because they both have prior arrests.
All three would have to plead guilty in order for Mrs. Greene, who has no criminal record, to receive the lesser punishment, the source said.
Lyle, 41, a plumber, and Dennis, 40, a registered nurse, could face up to 90 days in jail but, under the possible deal, they would also go free without incarceration or probation, the source said.
“If it happened, it was something stupid – so what?” said the couple’s lawyer, Vincent Siccardi.
“Nobody got hurt here – except them. They’re good, decent people.”
The family group was busted after a night of drinking last September on an early-morning LIRR train from Manhattan to Massapequa.
Several shocked passengers complained to a conductor about the menage a trois, police said.
When the uniformed conductor approached the Greenes and asked them to stop, Dennis allegedly refused, and the sex continued. Police boarded the train at Merrick and arrested the trio.
Dennis’ lawyer has asked the court to separate Dennis’ criminal case from that of his relatives.
