10TH SLAY RAP FOR ‘MOB COP’

Despite a “polished up” indictment adding new charges against two reputed mob-linked cops, a federal judge said yesterday he still doubts the prosecution’s case holds water.

Ex-NYPD Detective Louis Eppolito, 57, now is accused of killing a man – his 10th alleged murder victim – in 1987.

But prosecutors refused to tell Brooklyn federal Judge Jack Weinstein who the alleged victim was or if he was connected to the Mafia.

Former Detective Stephen Caracappa, still facing nine murder charges, is newly accused of using phony NYPD paperwork to retain his gun license while living in Las Vegas.

The two were charged in March with using their position within the NYPD to leak sensitive information to the Luchese crime family that mobsters used to commit gangland slayings.

Weinstein first questioned the prosecution case in July, when he freed the two on $5 million bail.

He still has little confidence in the feds’ case.

“They’ve polished up the prior indictment without addressing the issues,” he said.

He has twice questioned prosecutors on the validity of their argument that the retired detectives were still involved with organized crime during the time lapse between the last alleged murder in 1991 and the drugs they are accused of selling last year.

The new charges also indicate that the two were not Mafia flunkies taking orders, but rather they were their own bosses within the Lucheses.
