An obese Florida man who had tried to claim he was too fat to have murdered his former son-in-law was convicted yesterday after a New Jersey jury found his heavyweight defense too much to swallow.
Edward Ates, 62, looked down and shook his head in court as he was found guilty of murder and weapons counts for killing Paul Duncsak, who was shot six times at his home in Ramsey.
As soon as the verdict was read, Ates’ wife started blubbering in the gallery.
His “too fat to kill” defense hinged on his claim that his weight — 285 pounds and 62 years old at the time of the slaying — prevented him from climbing stairs and accurately shooting Duncsak in 2006.
But it didn’t sway the jury, who reached a verdict on their second day of deliberations.
