A Bronx appeals court has sided with the mother of a man killed a decade ago during a police confrontation.
A narcotics officer shot Malcolm Ferguson in the head in 2000. Police said Ferguson was a drug suspect who struggled when they stopped him. Prosecutors called the shooting an accident and did not charge the officer.
His mother, Juanita Young, was initially awarded $10.5 million. Then a court threw out that verdict.
On Thursday, the appeals panel said she should be compensated, though for a lesser amount: just under $3 million.
Young’s attorney, Seth Harris, said he hopes prosecutors will now take a fresh look at the case.
The city law department didn’t immediately comment.
