Housing cop David London violently beat a prone and cowering Iraq war veteran two years ago because the man was still “dangerous,” and was screaming, “I’m going to f- – -ing kill you!” the officer’s lawyer argued in Manhattan court yesterday.
“Just because an individual is in handcuffs, it doesn’t mean he is no longer a danger,” defense lawyer Stephen Worth insisted.
He noted that Walter Harvin had still been kicking while cuffed and collapsed on the floor of Hostas Houses on the Upper West Side as shown in surveillance video aired in court.
Prosecutor David Drucker countered that Harvin’s kicking and shoving the cop no way justified the 20 baton blows to the head, neck and shoulders while Harvin was clearly incapacitated — or the cop’s lies to prosecutors to frame Harvin for assault.
London is charged with felony assault and lying on paperwork.
