Kerry Kennedy will take the stand at her drugged-driving trial next month, lawyers for the ex-wife of Gov. Cuomo said after a court appearance Thursday.
In a hearing at Westchester Supreme Court, Kennedy’s lawyers renewed their motion to dismiss the case against her, arguing there is no evidence she purposely took the prescription sleeping aid detected by blood tests after she crashed her silver Lexus into a big rig on Interstate 684 in 2012 and drove away.
“[Prosecutors] have now conceded they have no evidence to contradict the notion that this was anything other than an accident,” lawyer Gerald Lefcourt said outside court, adding Kennedy was on her way to work out when she crashed. “Nobody takes a sleeping pill to go the gym.”
Lefcourt said the 54-year-old daughter of Robert F. Kennedy would testify in her own defense.
Prosecutors have until the end of the month to respond to her motion. They declined to comment.
Westchester Supreme Court Justice Robert Neary set a trial date of Feb. 24.
Kennedy waived her right to be present for jury selection. She will be in Western Sahara and Brussels for the human-rights organization named for her late father and will be back for the start of the trial.
