Surveillance video of the accuser in the Sanford Rubenstein rape probe shows her seemingly sober as she entered his Upper East Side apartment building and headed toward his plush penthouse, according to sources on both sides of the case.
“There are two videos: one (of her) coming in and one leaving. Going in, she seems fine,” a law-enforcement source said.
In addition, the source said she told cops that “she had two drinks at the party and two at his house, not enough to pass out.”
The 42-year-old woman has accused Rubenstein of raping her while she was incapacitated by booze after they both attended last week’s star-studded 60th birthday party for the Rev. Al Sharpton at the Four Seasons restaurant.
Rubenstein is a longtime Sharpton pal, while his accuser, who works as a retail exec, is a top official with Sharpton’s National Action Network activist group.
A source close to Rubenstein — who maintains he twice had consensual sex with the woman — said the first video shows her arm-in-arm with Rubenstein and a female friend on Rubenstein’s other arm as they walked about 100 feet from the front door to an elevator.
“It shows her upright, strutting into the lobby with Rubenstein and her friend, as if they were marching down the aisle at a wedding,” that source said, adding: “any suggestion this woman is stumbling around drunk is a complete fabrication.
Meanwhile, law-enforcement sources said that cops seized a sex toy and about 10 used condoms from Rubenstein’s penthouse and that items were being tested for the woman’s DNA.
The condoms were found in a garbage can, and some were bloody, the sources said.
The woman told cops she went to the hospital Friday evening because she was still bleeding more than 36 hours after the alleged attack early Thursday morning, according to sources.
The source close to Rubenstein said that if cops were testing the sex toy, “it will not in any way be linked to this woman because it was never used.”
The woman and her lawyer, Keith White, refused to comment as they emerged from a meeting with prosecutors in the Manhattan DA’s offices around 12:30 p.m., and again when White dropped her off at her Brooklyn home around 3 p.m.
Sources have described Rubenstein, 70, as an aging, skirt-chasing lothario who relies on his wealth and notoriety to seduce the much-younger gals he favors — tall, tough, tattooed types.
“The guy’s hung like a cashew,” a source said Monday of Rubenstein, with a longtime neighbor adding that prominent personal-injury lawyer relies on amenities such as stretch limos to attract women.
He is frequently seen squiring around women barely out of their teens, the neighbor said.
