A Frenchman has been convicted of rape by a Swiss court for removing his condom during sex with a woman who believed he still was wearing it, according to reports.
The landmark decision by the Criminal Court of Lausanne, Switzerland, came down Monday as the 47-year-old defendant was handed a suspended one year sentence, according to the Independent.
“This decision, which can be the subject of an appeal, is a first in Switzerland,” the victim’s lawyer, Baptiste Viredaz, told RTS INFO website. It was unclear why he received a suspended sentence.
The sex fiend, whose name was not released by authorities, had first met the Swiss woman on the popular dating app, Tinder, in 2015, the Independent reported.
Trouble came into paradise during their second date in June that year.
They went back to her home and had sexual intercourse after he agreed to her firm request to wear a condom, the newspaper said.
But during their encounter, he slipped off the condom and continued having sex.
She realized he had taken off the condom after the fact.
