NYPD detective accused of falsifying evidence, lying under oath

An NYPD detective was accused Tuesday of falsifying evidence against a pair of accused carjackers and lying about it under oath in federal court.

Det. Michael Foder, 41, was charged with two counts of perjury and one count of obstruction of an official proceeding for his testimony at a pretrial hearing in the Oct. 16, 2015, armed robbery of a livery cab driver.

The Brooklyn US Attorney’s office said Foder claimed he showed the victim photo arrays that included pictures of defendants Mardoche Petitphare and Rayvaughn Williams on Nov. 27, 2015, and Feb. 14, 2016, respectively.

But following his testimony, the feds discovered that some of the “filler” photos in the arrays were taken after those dates, “in conflict with Detective Foder’s testimony,” according to court records.

When prosecutors tried to interview Foder about the “apparent discrepancies,” he failed to show up for three scheduled meetings, then had a lawyer say he wouldn’t discuss the matter without a “proffer agreement” granting him immunity, the records show.

Petitphare and Williams later struck plea bargains in which they admitted attempting to hold up a McDonald’s restaurant on Nostrand Avenue in Brooklyn at gunpoint on Nov. 16, 2015.

In exchange, prosecutors dropped all charges in the robbery of the livery driver and another carjacking that occurred shortly after the botched McDonald’s caper.

Both men are awaiting sentencing.

Foder, who was stripped of his badge and gun in May, pleaded not guilty in Brooklyn federal court and was released on $25,000 bond. He was also suspended without pay by the NYPD.

Defense lawyer James Moschella said he planned to review the evidence against Foder, adding: “Right now, I am still kind of digesting everything.”
