A man who cruelly kicked a chihuahua down a city sidewalk, causing the pooch to lose an eye, skipped out on his sentencing Wednesday, forcing a Bronx judge to issue a warrant for his arrest.
Dwayne Smith, 28, pleaded guilty to aggravated cruelty to animals in November for kicking the 10-year-old pup in the head on Feb. 21.
The Norwood man hadn’t shown to his scheduled sentencing by Wednesday afternoon and Bronx Supreme court Judge April Newbauer said, “he also did not appear for his probation interview. I’m going to issue a bench warrant for him this time.”
The dog’s owner, Selida Gonzalez, saw her pet — named Pooches — “fly across the sidewalk, hit a cement wall, fall to the ground and lay motionless,” according to a criminal complaint.
Gonzalez told cops Pooches laid unconscious “with one eye bleeding and bulging out of its socket,” the court papers say.
A vet told Gonzalez that the canine’s right eye had to be removed, according to the court documents.
Smith was expected to receive two years behind bars under the terms of his plea agreement.
His lawyer declined to comment.
