Midtown bar blames actress Jennifer Agostini, model pal for wild brawl
A Midtown bar where an actress and her model pal claim they were brutally beaten during a wild brawl has blamed the women for the bloody incident, arguing that they were the “instigators,” as the bar released surveillance footage of the attack.
Sky Room claimed in a lengthy statement Monday that Jennifer Agostini, 43, and her swimsuit-model friend Prendinellys “Brenda” Garcia, 47, as well as other members of their party, were “hostile” and “aggressive” at the rooftop venue on W. 40th Street during the early hours of Nov. 24.
Sky Room spokesman Mike Paul says lobby surveillance footage shows Agostini and Garcia are to blame for the chaotic brawl.
Agostini and Garica, and two others, claimed in a Manhattan Supreme Court petition against Sky Room that they were jumped by a group of 10 to 15 people, including bouncers. They claim, in the petition, that racial slurs were directed at them, including “white motherf—-rs,” “dirty white b—-es” and “f–k those white b—-es and their money.”
Agostini, Garcia, Garcia’s husband, Cal Stuart, and friend Chris Seletti have not filed suit yet, but they filed a petition asking a judge to order Sky Room to disclose the videotape of the incident and preserve documentation regarding Sky Room’s security guards.
According to Agostini and Garcia, the incident sparked when one of their friends tried to go back into the bar for a forgotten credit card after their party had left.
Sky Room denies that, and claims the women approached another patron who was “taking money out of her own account with her own card” at a lobby ATM.
The bar said its security team tried to de-escalate the situation and that the women “ignored our security staff’s directives to be quiet and leave immediately.”
Then, Sky Room claims, the women “instigated a confrontation with another small party of customers in the front lobby area.”
Seventeen minutes of footage released by Sky Room show a wild brawl involving more than a half-dozen people unfold in the lobby area. The video doesn’t have audio and it’s unclear what was said or what initially triggered the fight.
In the footage, which a Manhattan judge ordered that the bar preserve, Agostini can be seen being pummeled on the floor before the fight spills outside.
Footage shows a bleeding Agostini hanging around outside the bar and appearing to shout at people at certain points for about 10 minutes.
Regarding Agostini’s injuries, the bar claims she could have sought “care for her small injury at the lounge or from an ambulance our staff offered her.”
Agostini told The Post that Sky Room’s claims are “absolutely ridiculous.”
“Me and my friends did not instigate anything. It’s the security’s job to protect paying customers and not let their friends jump us,” she said.
Agostini claimed $200, a chain and a pair of diamond earrings were taken in the scuffle.
She said she was waiting outside of the bar for an Uber to come take her to a hospital.
Garcia could not directly be reached for comment but Stuart, who was at the club that night and is a plaintiff in the case, argued that “The whole world can see we were assaulted. Remember we were VIP customers. We had just paid $1,000 bill.”
Selletti said he was pushed to the ground in the melee and fractured a rib.
“There was no one instigating,” Selletti said of himself and his friends.
