NYPD cops broke up a crowd of people drinking booze out of red plastic cups — and one of them turned out to be an ex-con with an illegal handgun who ran off and later told officers they only caught him because he was “drunk,” according to prosecutors.

The suspect, Kahmel Mobley — who is awaiting sentencing on state grand larceny rap — had a fanny pack strapped across his chest while he and several others allegedly boozed on Schenectady Avenue near St. John’s Park in Crown Heights at about 10:30 p.m. on June 5, according to a federal complaint unsealed against him Monday.

Six NYPD cops, who were riding in two different cars, pulled up to the crowd after spotting the red cups, according to the complaint.

Someone in the crowd then tapped Mobley on the shoulder to alert him to the cops — and he crossed the street, crouched behind a parked car and tried to ditch the fanny pack, the complaint states.

One of the cops approached him near the car — and Mobley took off running, throwing the fanny pack under another parked car on the street during a brief foot chase, according to the complaint.

The cop arrested Mobley and another officer recovered the fanny pack, which had a Bryco Arms semi-automatic pistol inside, prosecutors charged.

They took him to the nearby 77 precinct, where he allegedly owned up to carrying the piece.

“F—k it, it is what it is,” he allegedly told cops.

“I’d rather get caught with it than without it. Y’all lucky as a b—h,” he said, according to the complaint. “Let me not have been drunk, [the officers] were not catching me.”

Mobley was hit with a federal charge because he had previously been convicted of a felony, according to court papers.

He’s awaiting sentencing on the felony state grand larceny charge, which he was convicted of on April 13, according to the feds.

In 2014, he was convicted of felony burglary and sentenced to two years in prison, the complaint states.
